The Chief Magistrate did not fail to exercise jurisdiction nor act with material irregularity or injustice in dismissing Miscellaneous Application No. 195 of 2009 as premature, since the application was filed before the judgment was delivered and there was no decree to set aside. The Applicant failed to demonstrate any substantial loss that would result if stay of execution was not granted, did not act without unreasonable delay, and did not furnish security for costs as required under Order 43 rule 4(3) of the Civil Procedure Rules. The application for revision and stay of execution was therefore dismissed for lack of merit and non-fulfillment of procedural requirements.
