The Court found that the applicant had identified questions of fact that formed part of the labour officer's decision, specifically regarding the evaluation of evidence on reasons for termination and proof of funds. However, the Court reaffirmed its previous position that failure to evaluate evidence is a matter of law. Despite this, the Court granted the application for leave to appeal on questions of fact, as the applicant satisfied the statutory requirement under Section 94(2) of the Employment Act 2006. The absence of opposition from the respondents further supported the grant of leave.
