Ratio Decidendi

The District Land Tribunal lacked jurisdiction to hear the appeal from the LCIII Court Judgment, as agreed by both parties and supported by statutory and case law. The Court of Appeal did not annul the Tribunal's judgment because it was not brought to its attention. In line with Supreme Court precedent, where the error is attributable to the court and not the parties, it is just that each party bears its own costs. Therefore, the judgment of the District Land Tribunal is set aside, and each party is to bear its own costs.
