Ratio Decidendi

The Judgment Debtor failed to comply with the Bankruptcy Notice served under section 2(1)(g) of the Bankruptcy Act. The affidavit filed did not meet the requirements of Rule 140(2) of the Bankruptcy Rules, as it did not raise a counterclaim, set off, or cross demand against the Judgment Creditor. Claims against third parties do not qualify under the Act. The only valid grounds for setting aside a Bankruptcy Notice are those specified in the Act and Rules, which were not met. Consequently, the Judgment Debtor has committed an act of bankruptcy, and the Judgment Creditor is entitled to file a bankruptcy petition against him.
