Ratio Decidendi

The applicant failed to provide sufficient cause for not filing a written statement of defence within the prescribed time. The explanation of internal and overseas administrative new structures was vague and unsupported by evidence. The court found that the applicant did not meet the legal threshold for extension of time as established in Hadondi Daniel vs Yolam Egondi and under Order 51 Rule 6 of the Civil Procedure Rules. Consequently, the application to extend time and set aside the default judgment was dismissed.
