I think hearing was to be before the District Registrar. There is no minute in the }{\insrsid12639\charrsid13656858 court file for the above date. \par However, on 2}{\super\insrsid12639\charrsid13656858 nd}{\insrsid12639\charrsid13656858 }{\insrsid30223\charrsid13656858 August 1990 M/S Mugawba and Company Advocates a firm of Advocates representing the plaintiff filed in an amended plaint. M/S Mugamba and Co. Advocates did not indicate in the amended plaint whether they were amending the }{\insrsid12639\charrsid13656858 plaint under}{\i\insrsid30223\charrsid13656858 }{\insrsid30223\charrsid13656858 summary procedure rules or any plaint at all. The application for leave to appear and defend the su}{\insrsid12639\charrsid13656858 it was never heard before the D}{ \insrsid30223\charrsid13656858 istrict Registrar as should have been the case under order 46 rule 3 of the Civil Procedure rules which}{\insrsid12639\charrsid13656858 states:-}{\insrsid30223\charrsid13656858 }{\insrsid12639\charrsid13656858 \par }{\insrsid30223\charrsid13656858 \'93}{\i\insrsid30223\charrsid13656858 All formal steps preliminary to the trial and all interlocutory applications may be taken before }{\i\insrsid12639\charrsid13656858 that Registrar.\'94}{ \insrsid12639\charrsid13656858 \par Be that as it may on 19}{\super\insrsid12639\charrsid13656858 th}{\insrsid12639\charrsid13656858 October}{\insrsid30223\charrsid13656858 1990 the court file landed before this court. There were two matters }{\insrsid12639\charrsid13656858 before}{ \insrsid30223\charrsid13656858 the court for consideration. }{\insrsid12639\charrsid13656858 The}{\insrsid30223\charrsid13656858 }{\insrsid12639\charrsid13656858 application for leave to appe}{\insrsid30223\charrsid13656858 ar and defend the suit as required under order }{\insrsid30223\charrsid13656858 33}{\i\insrsid30223\charrsid13656858 }{\insrsid30223\charrsid13656858 r }{\insrsid30223\charrsid13656858 3}{\i\insrsid30223\charrsid13656858 }{ \insrsid12639\charrsid13656858 of the Civil P}{\insrsid30223\charrsid13656858 rocedure }{\insrsid12639\charrsid13656858 Rules and an amended plaint. }{\insrsid30223\charrsid13656858 The learned counsel representing the defendant seeks to have the }{ \insrsid12639\charrsid13656858 amended}{\insrsid30223\charrsid13656858 pla}{\insrsid12639\charrsid13656858 int dismissed under order 21 CPR hence this ruling. \par Mr. Nya}{\insrsid30223\charrsid13656858 kabwa of M/S Nyakabwa and Co. Advocates representing the plaintiff submitted that he will proceed with the chamber application under order }{\insrsid30223\charrsid13656858 6}{\i\insrsid30223\charrsid13656858 }{ \insrsid30223\charrsid13656858 r 21 of }{\insrsid12639\charrsid13656858 the CP}{\insrsid30223\charrsid13656858 R. He argued that the plaintiff filed a suit }{\insrsid12639\charrsid13656858 under summ}{\insrsid30223\charrsid13656858 ary procedure claiming certain amount of money and other relief. After }{\insrsid12639\charrsid13656858 service}{\insrsid30223\charrsid13656858 of the plaint and summons on the defendant they filed a }{\insrsid12639\charrsid13656858 notice of motion on 20}{\super\insrsid12639\charrsid13656858 th}{\insrsid12639\charrsid13656858 }{\insrsid30223\charrsid13656858 July 1990 seeking }{\insrsid12639\charrsid13656858 for leave to defend the suit. While}{\insrsid30223\charrsid13656858 the notice of motion was still }{\insrsid12639\charrsid13656858 pending}{\insrsid30223\charrsid13656858 due to be }{\insrsid15546653\charrsid13656858 heard on 5}{\super\insrsid15546653\charrsid13656858 th}{\insrsid15546653\charrsid13656858 }{ \insrsid30223\charrsid13656858 October, 1990. On 2nd }{\insrsid15546653\charrsid13656858 August 1990 th}{\insrsid30223\charrsid13656858 e pl}{\insrsid15546653\charrsid13656858 aintiff filed in an amended }{\insrsid30223\charrsid13656858 plaint \'93 without under summary procedure,\'94 That was duly served on them. He submitted that it was the amended plaint they were seeking the courts }{\insrsid15546653\charrsid13656858 power to dismi}{\insrsid30223\charrsid13656858 ss or disallow because it had completely changed the whole nature of the proceedings. He }{\insrsid15546653\charrsid13656858 referred}{\insrsid30223\charrsid13656858 me to the case of }{\b\ul\insrsid30223\charrsid13656858 Uganda Tran}{ \b\ul\insrsid15546653\charrsid13656858 sp}{\b\ul\insrsid30223\charrsid13656858 ort Co. Ltd }{\b\ul\insrsid15546653\charrsid13656858 vs. Count De}{\b\ul\insrsid30223\charrsid13656858 La pasture Civil Apea1 No. }{\b\ul\insrsid30223\charrsid13656858 83}{ \b\i\ul\insrsid30223\charrsid13656858 }{\b\ul\insrsid15546653\charrsid13656858 of 1953 Re}{\b\ul\insrsid30223\charrsid13656858 p. C. A. Eastern Africa Vol}{\b\ul\insrsid15546653\charrsid13656858 .}{\b\ul\insrsid30223\charrsid13656858 XXI 1954 }{ \b\ul\insrsid15546653\charrsid13656858 P}{\b\ul\insrsid30223\charrsid13656858 . }{\b\ul\insrsid30223\charrsid13656858 163}{\b\i\ul\insrsid30223\charrsid13656858 . }{\insrsid15546653\charrsid13656858 In that}{\insrsid30223\charrsid13656858 case the amended plaint was dismissed. I will consider this case later in my ruling. He prayed that the }{\insrsid15546653\charrsid13656858 amended}{\insrsid30223\charrsid13656858 plaint be dismissed. The }{\insrsid15546653\charrsid13656858 learned}{ \insrsid30223\charrsid13656858 counsel representing the plaintiff }{\insrsid15546653\charrsid13656858 submitted tha}{\insrsid30223\charrsid13656858 t he had read the dicta in the }{\insrsid15546653\charrsid13656858 above}{\insrsid30223\charrsid13656858 case and was of the view that the same }{\insrsid15546653\charrsid13656858 was not binding to this court}{\insrsid30223\charrsid13656858 . He contended that the terms of order 6 r 19 of the Civil Procedure rules is not necessarily the same as order 1 rule 19 of the Civil Procedure rules because in that judgment r eference is made to order 1 r 19 and not order 6 rule 19 of the Civil Procedure rules.. Th}{\insrsid15546653\charrsid13656858 at order 1 rule 19 does not ap}{\insrsid30223\charrsid13656858 ply to Uganda. }{\insrsid15546653\charrsid13656858 He submitted that the amended p}{\insrsid30223\charrsid13656858 laint was properly filed under th}{\insrsid15546653\charrsid13656858 e provision of Uganda Order 6 Rule }{\insrsid30223\charrsid13656858 19}{\insrsid15546653\charrsid13656858 of the Civil Procedure Rules. H}{\insrsid30223\charrsid13656858 ad the learned judges intended to state that order 6 r 19 does not apply to Uganda they would have clone so because }{\insrsid15546653\charrsid13656858 they used order 1}{ \insrsid30223\charrsid13656858 rule 19 }{\insrsid15546653\charrsid13656858 interchangeably.}{\insrsid30223\charrsid13656858 }{\insrsid15546653\charrsid13656858 So}{\insrsid30223\charrsid13656858 the judgment is not relevant to the present case. He prayed that the application be dismissed with costs as there was no need to seek clearance from court before }{\insrsid15546653\charrsid13656858 amendment. \par }{\insrsid30223\charrsid13656858 I}{\insrsid15546653\charrsid13656858 n reply Mr. Nya}{\insrsid30223\charrsid13656858 kabwa submitted that the judgment cited was that of th}{\insrsid15546653\charrsid13656858 e defunct court of Appeal for Ea}{ \insrsid30223\charrsid13656858 st Africa which was higher court then the high Court. }{\insrsid15546653\charrsid13656858 Its decisions on the relevant points of law have}{\insrsid30223\charrsid13656858 been binding on the High Court of Uganda although those decisions are not binding on the Supreme Court of Uganda to day. That holding No.}{\insrsid15546653\charrsid13656858 4 incorrectly refers to order 1}{\insrsid30223\charrsid13656858 rule 19. That was a typing err}{\insrsid15546653\charrsid13656858 or it should have been Order 6 R}{\insrsid30223\charrsid13656858 ule 19. The amendment took the case from order 33 }{\insrsid15546653\charrsid13656858 of the Civil Procedure R}{ \insrsid30223\charrsid13656858 ules without fresh summons being served on th}{\insrsid15546653\charrsid13656858 e}{\insrsid30223\charrsid13656858 defendant. The latter was confused. He prayed that the amendment be struck off with costs because it was made to defeat the purpose for which the original }{\insrsid15546653\charrsid13656858 suit was made. \par }\pard \s15\qj \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid15546653 {\insrsid30223\charrsid13656858 I have very carefully considered the }{\insrsid15546653\charrsid13656858 forceful}{ \insrsid30223\charrsid13656858 submissions by the learned counsels appearing for the parties. The matter is a simple one }{\insrsid15546653\charrsid13656858 whether}{\insrsid30223\charrsid13656858 the amended plaint should be struck out or disallowed as not conforming to the laid down rules as stipulated in order 6 r }{\insrsid15546653\charrsid13656858 19 of the Civil Procedure Rules. \par }\pard \s15\qj \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid12639 {\insrsid30223\charrsid13656858 \line }{\insrsid15546653\charrsid13656858 It is pertinent to note tha}{ \insrsid30223\charrsid13656858 t the }{\insrsid15546653\charrsid13656858 plaintiff file}{\insrsid30223\charrsid13656858 d a suit against }{\insrsid15546653\charrsid13656858 the}{\insrsid30223\charrsid13656858 }{\insrsid15546653\charrsid13656858 defendant }{\insrsid30223\charrsid13656858 under order }{\insrsid30223\charrsid13656858 33}{\i\insrsid30223\charrsid13656858 }{\insrsid30223\charrsid13656858 of th}{\insrsid15546653\charrsid13656858 e}{\insrsid30223\charrsid13656858 Civi}{ \insrsid15546653\charrsid13656858 l Procedure Rules. The summons o}{\insrsid30223\charrsid13656858 r plaint under the said suit was served on the defendant who filed in a notice of}{\insrsid15546653\charrsid13656858 motion seeking for leave to appear}{ \insrsid30223\charrsid13656858 and }{\insrsid15546653\charrsid13656858 defend}{\insrsid30223\charrsid13656858 the suit }{\insrsid15546653\charrsid13656858 under O}{\insrsid30223\charrsid13656858 rder }{\insrsid30223\charrsid13656858 33}{ \i\insrsid30223\charrsid13656858 }{\insrsid15546653\charrsid13656858 R}{\insrsid30223\charrsid13656858 ule 2 of the Civil Procedure rule}{\insrsid15546653\charrsid13656858 s. But before the application wa}{\insrsid30223\charrsid13656858 s heard the plaintiff filed in an amended plaint. }{\insrsid15546653\charrsid13656858 \par }{\insrsid30223\charrsid13656858 Under order }{\insrsid30223\charrsid13656858 6 }{\insrsid30223\charrsid13656858 rule 19 a plaintiff m}{\insrsid13709965\charrsid13656858 ay without leave amend his plaint}{\insrsid30223\charrsid13656858 once at any time within 21 days from the date }{\insrsid13709965\charrsid13656858 specified}{\insrsid30223\charrsid13656858 in the summons for the appearance of or the entering of an appearance by the defendant or where a }{ \insrsid13709965\charrsid13656858 written}{\insrsid30223\charrsid13656858 statement of defence is filed then within fourteen days from the filing of the written statement of defence or the }{\insrsid13709965\charrsid13656858 l}{ \insrsid30223\charrsid13656858 ast of such written statements. The plaintiff could make use }{\insrsid13709965\charrsid13656858 of}{\insrsid30223\charrsid13656858 Order 6 r 19 where he had filed in an ordinary plaint but not where a plaintiff has filed a suit under summary procedure order }{\insrsid30223\charrsid13656858 33}{\i\insrsid30223\charrsid13656858 }{\insrsid13709965\charrsid13656858 of the Civil P}{ \insrsid30223\charrsid13656858 rocedure}{\insrsid13709965\charrsid13656858 Rules}{\insrsid30223\charrsid13656858 . I had the }{\insrsid13709965\charrsid13656858 occasion}{\insrsid30223\charrsid13656858 to peruse the entire order }{ \insrsid30223\charrsid13656858 33}{\i\insrsid30223\charrsid13656858 }{\insrsid30223\charrsid13656858 but I di}{\insrsid13709965\charrsid13656858 d n}{\insrsid30223\charrsid13656858 ot see any provision whereby plaintiff could have carried out he }{ \insrsid13709965\charrsid13656858 amendment}{\insrsid30223\charrsid13656858 as was in the instant case. The amended plaint was struck out. Th}{\insrsid30223\charrsid13656858 e case just referred to above applies to the instant case. It is in fact an authority for the present situation where the plaintiff had filed in amended plaint before the court had the }{\insrsid13709965\charrsid13656858 occasion}{ \insrsid30223\charrsid13656858 to hear and dispose of the application for leave to appear and defe}{\insrsid13656858 nd the suit as }{\insrsid13709965\charrsid13656858 required under O}{\insrsid30223\charrsid13656858 rder }{ \insrsid30223\charrsid13656858 33}{\i\insrsid30223\charrsid13656858 }{\insrsid13709965\charrsid13656858 Rule 2 of the Civil Procedure R}{\insrsid30223\charrsid13656858 ules. It is inconceivable that the af fidavit filed in by the defendant for leave to appear and defend the suit could be taken as a written }{\insrsid13709965\charrsid13656858 statement}{\insrsid30223\charrsid13656858 of defence for the purpose of order }{\insrsid30223\charrsid13656858 6}{ \i\insrsid30223\charrsid13656858 }{\insrsid13709965\charrsid13656858 rule 19 of the Civil Procedure R}{\insrsid30223\charrsid13656858 ules. Bri}{\insrsid13709965\charrsid13656858 ggs J in his judgment at P. 166-}{\insrsid30223\charrsid13656858 l67}{ \insrsid13709965\charrsid13656858 }{\insrsid30223\charrsid13656858 had this -to say:\emdash }{\insrsid13709965\charrsid13656858 \par }{\i\insrsid13709965\charrsid13656858 \'93}{\i\insrsid30223\charrsid13656858 The argument is ingenious, for the affidavit does }{\i\insrsid13709965\charrsid13656858 perform }{\i\insrsid30223\charrsid13656858 the same function as a written statement of defence in an ordinary case in that it gives}{\i\insrsid13709965\charrsid13656858 the plaintiff his first intim}{\i\insrsid30223\charrsid13656858 ation of the nature of the defence to be raised, but in Uganda a written statement defence is a term of art and its meaning cannot be extended to cover an affidavit of this kind nor can it be said that convenience }{\i\insrsid8024782\charrsid13656858 requires}{\i\insrsid30223\charrsid13656858 the extension of the rule by }{\i\insrsid8024782\charrsid13656858 analogy}{\i\insrsid30223\charrsid13656858 to cover summary procedure cases. Indeed convenience seems to require that the rule or at least the provision for amendment before defence should not be}{\i\insrsid8024782\charrsid13656858 extended confusion might }{\i\insrsid30223\charrsid13656858 or both a}{\i\insrsid8024782\charrsid13656858 nd as to the time at which judgment might} {\i\insrsid30223\charrsid13656858 be obtained or application be made for leave to appear and defend.\'94 }{\i\insrsid8024782\charrsid13656858 \par }{\insrsid30223\charrsid13656858 I fully associate myself with}{\insrsid8024782\charrsid13656858 that exposition of the law as }{\insrsid30223\charrsid13656858 expounded by the learned Judge perhaps I w}{\insrsid8024782\charrsid13656858 ould add that the amended }{\insrsid30223\charrsid13656858 plaint was without legal foundation. It }{\insrsid8024782\charrsid13656858 was jeered at making a mockery }{\insrsid30223\charrsid13656858 of our Civil Procedure rules more since th}{ \insrsid8024782\charrsid13656858 e learned counsel did not even }{\insrsid30223\charrsid13656858 mention the law under which the amendment was }{\insrsid8024782\charrsid13656858 purportedly}{\insrsid30223\charrsid13656858 made.}{ \insrsid8024782\charrsid13656858 \par Mr. Mugamba submitted that Order 1 Rule}{\insrsid30223\charrsid13656858 19 mentioned in holding }{\insrsid8024782\charrsid13656858 no.4 of the }{\insrsid30223\charrsid13656858 case quoted above }{\insrsid8024782\charrsid13656858 was}{ \insrsid30223\charrsid13656858 not applicable to the instant case and }{\insrsid8024782\charrsid13656858 that}{\insrsid30223\charrsid13656858 th}{\insrsid8024782\charrsid13656858 e}{\insrsid30223\charrsid13656858 }{\insrsid8024782\charrsid13656858 case }{\insrsid13656858 }{\insrsid8024782\charrsid13656858 referred}{\insrsid30223\charrsid13656858 to }{\insrsid8024782\charrsid13656858 was not binding to this court. W}{\insrsid30223\charrsid13656858 ith respect to the learned counsel Brigg}{ \insrsid8024782\charrsid13656858 s}{\insrsid30223\charrsid13656858 J. A in his judgment}{\insrsid8024782\charrsid13656858 throughout was referring to O}{\insrsid30223\charrsid13656858 rder 6 }{\insrsid8024782\charrsid13656858 Rule 19. He did not mention order 1}{\insrsid30223\charrsid13656858 & 19 in his judgment. I am of }{\insrsid8024782\charrsid13656858 the}{\insrsid30223\charrsid13656858 view that the mention of order 1 rule 19 in holding No. 4 was a typing error. The proper order }{\insrsid8024782\charrsid13656858 should}{\insrsid30223\charrsid13656858 have been order 6 rul}{\insrsid8024782\charrsid13656858 e 19 of}{ \insrsid30223\charrsid13656858 the Civil Procedure rule and in this way I endorse }{\insrsid8024782\charrsid13656858 the submission of the learned }{\insrsid30223\charrsid13656858 counsel for the defendant }{\insrsid8024782\charrsid13656858 o}{ \insrsid30223\charrsid13656858 ver this issue. That the quoting of order 1 r 19 in holding }{\insrsid8024782\charrsid13656858 No.4 of}{\insrsid30223\charrsid13656858 the said case wa}{\insrsid8024782\charrsid13656858 s a typing error. Mr. Mugamba had }{ \insrsid30223\charrsid13656858 further submitted that the decision of Her Majesty court as a court of appeal for Eastern Africa was not binding on this court. The learned counsel did n}{\insrsid8024782\charrsid13656858 ot cite me any authority to fortify} {\insrsid30223\charrsid13656858 his assertion. It suffices here to note that though the Eastern Africa court of appeal h}{\insrsid8024782\charrsid13656858 a}{\insrsid30223\charrsid13656858 d }{\insrsid8024782\charrsid13656858 disintegrated}{ \insrsid30223\charrsid13656858 the practice has been that the decisions of that court still binds the High court here and we have been following them.
