The Court found that the applicants failed to satisfy the mandatory conditions for grant of an interim stay of execution. While a notice of appeal was filed and the application was made without unreasonable delay, there was no substantive application for stay of execution pending before the court, contrary to the requirements. The High Court order being appealed against merely dismissed the application for judicial review with costs and did not contain any executable order or direct removal of the caveat.
