Ratio Decidendi

The Assistant Registrar erred in awarding costs against Acholi War Debts Claimant Association, a nonexistent party lacking legal capacity to sue or be sued. The respondents, having initiated proceedings without proper authorisation and acting as the real litigants behind the suit, are personally liable for the costs of the withdrawn proceedings. The court has inherent jurisdiction to order costs against non-parties who are the substantial litigants and who misuse the court's process by instituting proceedings in the name of an entity without legal personality. The application for review is allowed, and the respondents are ordered to pay the costs personally.
