The application for leave to appeal was dismissed because the supporting affidavit, which formed the basis of the application, was struck out. The court found that the affidavit contained material contradictions regarding the authority of the 4th respondent to enter into the consent judgment, and the deponent failed to appear for cross-examination to clarify these contradictions.
