Ratio Decidendi

The High Court determined that it lacked jurisdiction to entertain the application for leave to appeal out of time against its own ruling denying leave. The law and precedent establish that when the High Court refuses leave to appeal, the applicant's remedy is to apply to the appellate court, not to seek further leave or validation from the High Court. Furthermore, no appeal lies against a discretionary order refusing leave. The application was therefore incompetent and bad at law, and the only proper course for the applicant is to lodge a fresh application for leave in the Court of Appeal.
