Ratio Decidendi

The court held that under Section 82 of the Civil Procedure Act and Order 46 rule 1 of the Civil Procedure Rules, a party who has filed a notice of appeal is barred from seeking review of the same judgment or order. The applicant in this case had already lodged a notice of appeal and requested certified copies of proceedings, actions which transferred jurisdiction over the matter to the appellate court. As such, the High Court lacked jurisdiction to entertain the application for review or to grant a stay of execution. The application was therefore incompetent and struck out with costs to the respondent.
