[1937] EACA 154

[1937] EACA 154

The court held that while there was a chain of circumstantial evidence linking the accused to the deceased up to a certain point, there was nothing thereafter to connect them. The evidence did not exclude all reasonable alternatives that could account for the death. The standard for conviction in cases relying on circumstantial evidence requires that the evidence must lead to the inevitable conclusion of guilt, excluding any other reasonable hypothesis. As this certainty was lacking, the conviction could not stand. The appeal was therefore allowed and the conviction quashed.

  2. 2 Whether any reasonable alternative explanation for the death existed, excluding the accused's responsibility.

Ratio Decidendi

The court held that while there was a chain of circumstantial evidence linking the accused to the deceased up to a certain point, there was nothing thereafter to connect them. The evidence did not exclude all reasonable alternatives that could account for the death. The standard for conviction in cases relying on circumstantial evidence requires that the evidence must lead to the inevitable conclusion of guilt, excluding any other reasonable hypothesis. As this certainty was lacking, the conviction could not stand. The appeal was therefore allowed and the conviction quashed.
