[1932] EACA 34

[1932] EACA 34

The appellate court held that the Resident Magistrate erred in treating the suit as execution proceedings under the original decree without hearing evidence. The new contract resulting from the settlement between the parties after judgment introduced new matters, and thus could not be enforced as a proceeding under the original decree pursuant to section 34 (2) of the Civil Procedure Ordinance. The conversion prejudiced the defendant by exposing him to immediate arrest, whereas a judgment on the new contract would entitle him to additional time to pay. The appeal was allowed, and the matter remitted for trial on its merits.
