Ratio Decidendi

The Plaintiff proved ownership of the suit land through purchase and transfer from parties who had acquired it from the Defendants. The Defendants, having sold their interest, had no lawful claim to the land but interfered with the Plaintiff's possession by destroying his property. The court found that such interference constituted trespass. The Plaintiff was entitled to recovery of the land and general damages calculated based on the period of loss and interference, as well as costs of the suit. The absence of a defence from the Defendants and the unchallenged evidence led to judgment in favour of the Plaintiff.
