Ratio Decidendi

The African Court on Human and Peoples' Rights manifestly lacks jurisdiction to entertain the application against the Republic of South Africa because South Africa has not made the declaration required under Article 34(6) of the Protocol. The Protocol expressly provides that the Court shall not receive any petition under Article 5(3) involving a State Party which has not made such a declaration. The Court confirmed with the African Union Commission that South Africa had not made the requisite declaration. Accordingly, the application must be struck out from the general list of the Court.
