Order 19 rule 23(1) of the Civil Procedure Rules does not apply to the court that passed the decree, but only to a court to which the decree has been sent for execution. Furthermore, section 101 of the Civil Procedure Act, which provides for inherent jurisdiction, cannot be invoked where there is another remedy available under the law. Since there was a pending application to set aside the ex parte judgment, the applicant had a remedy under the Civil Procedure Rules, making the invocation of inherent jurisdiction inappropriate.
