The plaintiff was a bona fide purchaser for value without notice of the dispute. The defendants expressly undertook to indemnify the plaintiff in case of any defect in title. When a court order decreed the land to a third party, the plaintiff was compelled to pay Ug. Shs. 120,000,000/= to salvage its investment.
