The trial Judge erred by failing to consider the period the appellant spent on remand and by not weighing mitigating factors, rendering the sentence illegal under Article 23(8) of the Constitution. The appellate court set aside the 25-year sentence and, after considering both mitigating and aggravating factors—including the appellant's status as a first offender, his remorse, his dependent child, and his HIV status at the time of the offence—imposed a sentence of 18 years' imprisonment from the date of conviction.
