Notice of dishonour was communicated to the defendant, and the defendant failed to make good on the refund despite reminders. The court held that the plaintiff was entitled to a refund of the Shs.5,000,000.00 paid, with interest awarded at 17% per annum from the date of the dishonoured cheque until judgment, and thereafter at the court rate until payment in full. Costs were also awarded to the plaintiff. The defendant's defences were unsupported by evidence and rejected.
