The court found that the Taxing Master erred in law by applying the old Advocates (Remuneration & Taxation of Costs) Rules S.I 267-4 instead of the applicable 2018 amendment regulations, as the instructions were taken before the amendment but the bill was filed after. The court held that the application of the wrong law rendered the taxation proceedings unfounded in law and warranted setting aside the award.
