Ratio Decidendi

The court found that the affidavit in support of the application was largely defective, containing averments that were hearsay, argumentative, and not within the deponent's personal knowledge, contrary to Order 19 Rule 3 of the Civil Procedure Rules. After expunging the offending paragraphs, the remaining parts of the affidavit did not disclose any credible defence or triable issue. The application was therefore declared incompetent and struck out. Consequently, the court entered judgment for the respondent in the summary suit, awarding the outstanding sum, interest at the agreed rate, and costs, as the applicant had acknowledged the debt and failed to honor its payment proposal.
