The court held that while the presumption of innocence and the right to apply for bail are constitutionally protected, the applicant must satisfy the statutory and judicial requirements for bail, including proving a fixed place of abode within the jurisdiction. The applicant failed to provide sufficient documentary evidence to establish his fixed place of abode, as there was a variance between the address on his national ID and the one stated in his affidavit, and no LC1 letter or other supporting document was attached. The absence of proof of a fixed place of abode is a critical failure, and as such, the court cannot be satisfied that the applicant will not abscond if released on bail....
