Ratio Decidendi

The Plaintiff's vehicle was damaged by floods while in the custody of the Defendant's bonded warehouse. The Defendant, as bailee, owed a duty of care to keep the vehicle safely and failed in this obligation, resulting in liability for the damage. The Plaintiff satisfactorily proved entitlement to general damages for loss of business and special damages for repair costs, legal fees, and related expenses, but failed to prove certain other claimed losses. The Court exercised discretion to award interest at commercial rates and apportioned costs in light of the Defendant's attempt to settle. The Plaintiff is entitled to compensation for proven losses, interest, and a portion of taxed costs.
