There was no evidence to support the prosecution's claim that the appellant was a habitual criminal. The sentence of 1 year imprisonment for theft of socks valued at 25,000 UGX was deemed harsh and excessive in light of the mitigating factors. The appellate court exercised its discretion to vary the sentence to 3 months, which the appellant had already served, and ordered his release unless held on other lawful charges.
