The Court held that its jurisdiction is strictly defined by the Protocol establishing it. Under Articles 5(3) and 34(6), individuals and NGOs may only bring cases directly before the Court against States Parties that have ratified the Protocol and made the requisite declaration accepting the Court's competence. The African Union, as an international organization, is not a State Party to the Protocol and cannot make such a declaration. The Protocol does not provide for the African Union to be sued before the Court for obligations of its Member States.
