Ratio Decidendi

The court found that First Finance Group Ltd had locus standi to sue for the recovery of the loan because it had lawfully acquired the assets and liabilities of Future Finance Group Ltd through a registered resolution. The evidence, including cheques, letters of acknowledgment, and expert testimony, established that the Defendant had received the loan and provided security for it. The Defendant's denials were found to be unreliable and contradicted by his own admissions and the documentary evidence. The Plaintiff was therefore entitled to recover the sum of USD 30,000 from the Defendant, together with costs of the suit.
