Ratio Decidendi

The High Court found that the trial Magistrate Grade 1 lacked jurisdiction to entertain and determine a counterclaim for UGX 26,000,000 and to award compensation and general damages totaling UGX 30,000,000, as these amounts exceeded the statutory pecuniary jurisdiction of UGX 20,000,000 under Section 207(1)(b) of the Magistrates Courts Act. Jurisdiction is strictly statutory, and proceedings conducted without it are a nullity ab initio. The trial magistrate's orders regarding the counterclaim and damages were therefore void and must be set aside. The appeal succeeded on the basis that the lower court's lack of jurisdiction rendered all related proceedings and orders null and void.
