The Court of Appeal found that Apollo Hotel Corporation Limited was the legal successor to Apollo Hotel Corporation and, by operation of the Public Enterprises Reform and Divestiture Statute, 1993, became the owner and operator of the hotel at the material time. The Government of Uganda, while holding a majority shareholding, was not the direct owner or employer. The management agreement and appointment letters did not override the statutory and corporate succession. The trial judge erred in striking out the suit on the basis that the respondent was not the proper party. The respondent was the correct defendant for employment-related claims, and the suit disclosed a valid cause of action....
