The termination was }{\insrsid12986828\charrsid3307147 by first sending her on an indefinite forced leave on 30.01.99 and subsequently retiring her from service in the public interest on 05.08.99. \par \par The }{\insrsid14290080\charrsid3307147 defendant is a Local Government}{\insrsid12986828\charrsid3307147 established under the}{\insrsid14290080\charrsid3307147 then The}{\insrsid12986828\charrsid3307147 Local Governments Act}{ \insrsid14290080\charrsid3307147 No.1 1997; now The Local Governments Act, Cap.243}{\insrsid12986828\charrsid3307147 , }{\insrsid5391583\charrsid3307147 Laws of Uganda, 2000 Edition.}{\insrsid12986828\charrsid3307147 \par }{\insrsid14290080\charrsid3307147 By way of background, t}{\insrsid12986828\charrsid3307147 he employer/employee relationship between the defendant and plaintiff deteriorated resulting in the plaintiff being subject}{\insrsid14290080\charrsid3307147 ed to disciplinary pro}{\insrsid12986828\charrsid3307147 ce}{\insrsid14290080\charrsid3307147 edings in 1999. T}{\insrsid12986828\charrsid3307147 he defendant, in accordance with the then obtaining law, raised a number of charges against the plaintiff on account of which it sought to remove her from office. A tribunal of three (3) High Court Judges}{\insrsid14290080\charrsid3307147 he aded by Musoke-Kibuuka, J., (herein after to be reffered to as \'93The Tribunal)\'94,}{\insrsid12986828\charrsid3307147 was constituted and did investigate the charges against the plaintiff. The Tribunal, at the end of the investigation, found that the plaintiff ha}{\insrsid14290080\charrsid3307147 d}{\insrsid12986828\charrsid3307147 no case to answer on each of the charges brought against her and thus concluded that the statutory grounds upon which the plaintiff could be removed from office had not been established. The tribunal report was issued on 21.06.99. Its final conclusion was:- \par \tab }{\b\insrsid12986828\charrsid3307147 \'9389. In the circumstance}{\b\insrsid14290080\charrsid3307147 s}{\b\insrsid12986828\charrsid3307147 , we have no option, but to make \tab only one final finding. It is that, on the basis of the }{ \b\insrsid1796228\charrsid3307147 \tab }{\b\insrsid12986828\charrsid3307147 evidence \tab adduced before us, in respect of all the }{\b\insrsid1796228\charrsid3307147 \tab }{\b\insrsid12986828\charrsid3307147 allegations contained in the instrument constituting this }{\b\insrsid1796228\charrsid3307147 \tab }{\b\insrsid12986828\charrsid3307147 Tribunal no prima facie case exists, within the meaning of }{\b\insrsid1796228\charrsid3307147 \tab }{ \b\insrsid12986828\charrsid3307147 the provisions of sections \tab 69(2) and 15, of the LGA, }{\b\insrsid1796228\charrsid3307147 \tab }{\b\insrsid12986828\charrsid3307147 1997, for the removal of Mrs Gladys Aserua \endash Orochi from }{ \b\insrsid1796228\charrsid3307147 \tab }{\b\insrsid12986828\charrsid3307147 office as CAO, Kabale District.\'94 }{\b\insrsid1796228\charrsid3307147 }{\b\insrsid12986828\charrsid3307147 \par }{\insrsid1796228\charrsid3307147 Inspite of the above final conclusion of the tribunal, the Kabale District Service Commission (DSC)}{\insrsid5197770\charrsid3307147 ,}{\insrsid1796228\charrsid3307147 a statutory organ of the defendant, proceeded to and did retire the Plaintiff from the defendant}{\insrsid5197770\charrsid3307147 \rquote s}{\insrsid1796228\charrsid3307147 employment as Chief Administrative Officer. The result of this failure was that }{\insrsid5197770\charrsid3307147 the plaintiff was removed from office without the District Council first, or at all, passing a resolution and requesting the District }{\insrsid1014101\charrsid3307147 Service Commission}{\insrsid5197770\charrsid3307147 to remove plaintiff from office.}{ \insrsid1014101\charrsid3307147 Plaintiff }{\insrsid5197770\charrsid3307147 further}{\insrsid1014101\charrsid3307147 contended that the act of the District Service Commission of retiring her in the public interest was taken without giving her notice and a hearing, and as such }{\insrsid5197770\charrsid3307147 was }{\insrsid1014101\charrsid3307147 contrary to the rule s of natural justice.}{\insrsid15538833\charrsid3307147 \par }{\insrsid1014101\charrsid3307147 \par For the defendant}{\insrsid5197770\charrsid3307147 ,}{\insrsid1014101\charrsid3307147 Mr. Christopher Rwanika, who in 1999}{\insrsid5197770\charrsid3307147 ,}{\insrsid1014101\charrsid3307147 when the plaintiff was retired}{ \insrsid5197770\charrsid3307147 ,}{\insrsid1014101\charrsid3307147 was Chairperson of the Defendant\rquote s District Service Commission, testified to the effect that the Council relied on the District Council resoluti on that the council had made prior to setting up the tribunal seeking the plaintiff\rquote s removal from office. \par \par This witness further explained that since the plaintiff had been given a hearing by the Tribunal, it was not necessary to give her a }{\insrsid5197770\charrsid3307147 further }{\insrsid1014101\charrsid3307147 hearing by the District Service Commission before deciding to retire }{\insrsid5197770\charrsid3307147 her from her employment with the defendant.}{\insrsid1014101\charrsid3307147 \par \par }{\insrsid5197770\charrsid3307147 This court finds on the facts and the law before it, that th}{\insrsid1014101\charrsid3307147 e plaintiff, at the material time, as Chief Administrative Officer of the Defendant, was a public officer in terms of Article 175 of the }{\insrsid5197770\charrsid3307147 1995 }{\insrsid1014101\charrsid3307147 Constitution. As such she enjoyed the constitutional protection of public officers under Article 173 of the Constitution. She could not be victimized or discriminated against for having performed her d uties faithfully in accordance with the Constitution, or be dismissed or removed from office or reduced in rank or otherwise punished without just cause. \par \par }{\insrsid14042876\charrsid3307147 Sections 15 and 69(2) of the then Local Government Act}{\insrsid5197770\charrsid3307147 No.1 of}{\insrsid14042876\charrsid3307147 1997, provided for the procedure to be followed to remove a Chief Administrative officer from office. That procedure, no doubt, was to execute the intent and effect of Article 173 of the Constitution.}{\insrsid1014101\charrsid3307147 \par }{\insrsid14042876\charrsid3307147 \par According to Section 15 of the }{\insrsid5197770\charrsid3307147 said }{\insrsid14042876\charrsid3307147 Act, the procedure to remove a Chief Administrative Off icer from office was exactly the same as that which had to be taken to remove from office a Chairperson of the District}{\insrsid5391583\charrsid3307147 ,}{\insrsid14042876\charrsid3307147 with only one exception}{\insrsid5391583\charrsid3307147 ,}{ \insrsid14042876\charrsid3307147 to be }{\insrsid5197770\charrsid3307147 considere}{\insrsid5132972\charrsid3307147 d}{\insrsid5197770\charrsid3307147 later on }{\insrsid5132972\charrsid3307147 in this judgment}{\insrsid14042876\charrsid3307147 . \par \par }{\insrsid5132972\charrsid3307147 In summary the procedure}{\insrsid14042876\charrsid3307147 , was that a notice of intention to pass a resolution }{\insrsid5197770\charrsid3307147 of the}{\insrsid14042876\charrsid3307147 council to remove the Chief Administrative Officer had to be submitted to the speaker of the Defendant. This notice had to be in writing and signed by not less than }{\insrsid1255510\charrsid3307147 one third of all the members of the defendant. The notice had to state that the signatories to it intended to pass a resolution o}{\insrsid5132972\charrsid3307147 f the Council to remove the CAO. The same notice}{\insrsid1255510\charrsid3307147 had}{ \insrsid5132972\charrsid3307147 also to set out the particulars of the allegations against the CAO. The allegations had to fall}{\insrsid1255510\charrsid3307147 under the categories set out in section 69 of the Act, which stipulate}{ \insrsid5132972\charrsid3307147 d}{\insrsid1255510\charrsid3307147 that the CAO can only be removed from office for: }{\insrsid14042876\charrsid3307147 \par {\listtext\pard\plain\lang1033\langfe1033\langnp1033\langfenp1033\insrsid1255510\charrsid3307147 \hich\af0\dbch\af0\loch\f0 a)\tab}}\pard \qj \fi-435\li1515\ri-720\sl360\slmult1\widctlpar \jclisttab\tx1515\aspalpha\aspnum\faauto\ls2\ilvl1\adjustright\rin-720\lin1515\itap0\pararsid3307147 {\insrsid1255510\charrsid3307147 abuse of office \par {\listtext\pard\plain\lang1033\langfe1033\langnp1033\langfenp1033\insrsid1255510\charrsid3307147 \hich\af0\dbch\af0\loch\f0 b)\tab}incompetence \par {\listtext\pard\plain\lang1033\langfe1033\langnp1033\langfenp1033\insrsid1255510\charrsid3307147 \hich\af0\dbch\af0\loch\f0 c)\tab}misconduct or misbehaviour or \par {\listtext\pard\plain\lang1033\langfe1033\langnp1033\langfenp1033\insrsid1255510\charrsid3307147 \hich\af0\dbch\af0\loch\f0 d)\tab}such physical or mental incapacity as would render the Chief Administrative Officer incapable of performing the duties of Chief Administrative Officer. \par }\pard \qj \li0\ri-720\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin-720\lin0\itap0\pararsid3307147 {\insrsid1255510\charrsid3307147 The speaker, on receipt of the notice, had to transmit the same to the CAO and the Chief Justice within 24 hours. The Chief Justice then, within seven days of the receipt of the notice had to constitute a Tribunal of three Judges of the High Court to investigate the allegations in the Notice. The Tribunal had to determine whether or not there was prima facie case for the remov}{\insrsid5132972\charrsid3307147 al of the CAO; and for purposes of T}{ \insrsid1255510\charrsid3307147 he Local Governments Act}{\insrsid5132972\charrsid3307147 No.1}{\insrsid5391583\charrsid3307147 of 19}{\insrsid5132972\charrsid3307147 97}{\insrsid1255510\charrsid3307147 , }{\b\insrsid1255510\charrsid3307147 prima facie case}{\insrsid1255510\charrsid3307147 , }{\insrsid5132972\charrsid3307147 mea}{\insrsid1255510\charrsid3307147 nt that}{\insrsid5132972\charrsid3307147 ,}{\insrsid1255510\charrsid3307147 the allegations had to be proved on a balance of probabilities, the standard of proof required for the p}{\insrsid5132972\charrsid3307147 roof of issues in the ordinary civil s}{\insrsid1255510\charrsid3307147 uits. \par \par At the end of the investigation by the Tribunal, a report of the tribunal containing its findings had to be submitted to the District Service Commission }{\insrsid5132972\charrsid3307147 for the said Commission }{\insrsid1255510\charrsid3307147 to take appropriate action. }{\insrsid5132972\charrsid3307147 Herein lies}{\insrsid1255510\charrsid3307147 the substantial exception in procedure in contra}{\insrsid5132972\charrsid3307147 s}{\insrsid1255510\charrsid3307147 t to that of removal of the District Chairperson. In the case of the }{\insrsid5132972\charrsid3307147 District Chairperson}{\insrsid1255510\charrsid3307147 , the Tribunal}{\insrsid5132972\charrsid3307147 , after investigating}{ \insrsid15205645\charrsid3307147 , had}{\insrsid1255510\charrsid3307147 to submit its report of findings to the speaker of the Council and the Council would then}{\insrsid15205645\charrsid3307147 ,}{\insrsid1255510\charrsid3307147 }{ \insrsid15205645\charrsid3307147 if the tribunal found a prima facie case made out, }{\insrsid1255510\charrsid3307147 proceed to consider the motion for resolution for removal of Chairperson from office. \par \par The law as to procedure for the removal of a CAO from office as set out above, }{\insrsid6647952\charrsid3307147 was}{\insrsid1255510\charrsid3307147 the law applicable as at the time the facts constituting the cause of action of the plaintiff\rquote s case arose. It was contained in }{\insrsid15205645\charrsid3307147 T}{\insrsid1255510\charrsid3307147 he Local Governments Act}{\insrsid15205645\charrsid3307147 No.1}{\insrsid1255510\charrsid3307147 }{\insrsid5391583\charrsid3307147 of }{ \insrsid1255510\charrsid3307147 1997. It is thus the law applicable to this case. Since then however the Local Governments Act, No.1 of 1997, has been amended and the current}{\insrsid15205645\charrsid3307147 The Local Governments Act}{ \insrsid1255510\charrsid3307147 , Cap.243 in the 2000 Uganda Edition Laws, no longer carries the same procedure for removal of a CAO from office. \par \par }{\insrsid285900\charrsid3307147 From the evidence adduced before this Court by both sides to the suit, the events leading to the plaintiff\rquote s removal from office are in summary, that on 29}{\super\insrsid285900\charrsid3307147 th}{ \insrsid285900\charrsid3307147 \endash to 30}{\super\insrsid285900\charrsid3307147 th}{\insrsid285900\charrsid3307147 January, 1999, the defendant Council sat and considere d reports of its standing committees. In the course of considering the report of the Finance Committee, the defendant Council resolved and sent the plaintiff, as the Chief Administrative }{\insrsid6647952\charrsid3307147 Officer,}{ \insrsid285900\charrsid3307147 on indefinite forced leave, effective 30}{\super\insrsid285900\charrsid3307147 th}{\insrsid285900\charrsid3307147 January, 1999, pending investigations by the Council Committee into the Plaintiff\rquote s financial mismanagement and abuse.}{\insrsid1255510\charrsid3307147 \par }{\insrsid285900\charrsid3307147 \par The plaintiff thus left office. On 3}{\super\insrsid285900\charrsid3307147 rd}{\insrsid285900\charrsid3307147 March, 1999, the District Council Chairperson, Dr. Mwesigye Runumi Francis, wrote to the plaintiff recalling her to resume the duties of her office, regretting what the defendant council had done to her. The Plaintiff resumed work on 9}{\super\insrsid285900\charrsid3307147 th}{\insrsid285900\charrsid3307147 March, 1999. }{\insrsid15205645\charrsid3307147 H}{ \insrsid285900\charrsid3307147 owever on 29}{\super\insrsid285900\charrsid3307147 th}{\insrsid285900\charrsid3307147 March, 1999, on receipt of the report of the}{\insrsid15205645\charrsid3307147 Council\rquote s }{\insrsid285900\charrsid3307147 investigating Committee}{\insrsid5391583\charrsid3307147 into the alleged Plaintiff\rquote s}{\insrsid15205645\charrsid3307147 financial mismanagement and abuse,}{\insrsid285900\charrsid3307147 set up on 30}{\super\insrsid285900\charrsid3307147 th}{ \insrsid285900\charrsid3307147 January 1999, the defendant council, insisted on}{\insrsid15205645\charrsid3307147 ,}{\insrsid285900\charrsid3307147 and implemented again}{\insrsid15205645\charrsid3307147 ,}{\insrsid285900\charrsid3307147 its resolution of 30}{\super\insrsid285900\charrsid3307147 th}{\insrsid285900\charrsid3307147 January, 1999, sendin}{\insrsid15205645\charrsid3307147 g the plaintiff on forced leave. The Council further }{\insrsid285900\charrsid3307147 resolved that a submission be made to the District Service Commission recommending that the plaintiff be removed from the office of Chief Administrative Officer of the District immediately. It is subsequent to these events that }{ \insrsid15205645\charrsid3307147 His Lordship }{\insrsid285900\charrsid3307147 the Chief Justice appointed the Tribuna l of the three Judges of the High Court to investigate whether or not a prima facie case existed for the removal of the plaintiff from office. \par \par As already stated, the Tribunal exonerated the plaintiff of all the allegations put up as the reasons for removal from office of Chief Administrative Officer. The Tribunal Report}{\insrsid15205645\charrsid3307147 , in accordance with the law,}{ \insrsid285900\charrsid3307147 was submitted }{\insrsid15205645\charrsid3307147 to}{\insrsid285900\charrsid3307147 the }{\insrsid15205645\charrsid3307147 Defendant\rquote s }{\insrsid285900\charrsid3307147 District Service Commission; and, the exoneration of the plaintiff by the Tribunal notwithstanding}{\insrsid15205645\charrsid3307147 ,}{\insrsid285900\charrsid3307147 the }{\insrsid15205645\charrsid3307147 Commission resolved, inter alia,}{ \insrsid285900\charrsid3307147 }{\insrsid6647952\charrsid3307147 to retire the plaintiff from service in the public interest.}{\insrsid285900\charrsid3307147 \par }{\insrsid6647952\charrsid3307147 \par In the considered view of this Court given the position of the law as provided in }{\insrsid15205645\charrsid3307147 T}{\insrsid6647952\charrsid3307147 he Local Government}{\insrsid15205645\charrsid3307147 s}{\insrsid6647952\charrsid3307147 Act No.1 of 1997, after the Tribunal }{\insrsid15205645\charrsid3307147 of the three judges }{\insrsid6647952\charrsid3307147 had completed its findings and submitted its Report}{\insrsid15205645\charrsid3307147 to the District Service Commission}{ \insrsid6647952\charrsid3307147 , the law did not require that the District Council speaker again convenes another meeting of the Council }{\insrsid15205645\charrsid3307147 to}{\insrsid6647952\charrsid3307147 again }{\insrsid15205645\charrsid3307147 pass another }{\insrsid6647952\charrsid3307147 appropriate Resolution of Council on whether or not to remove the plaintiff from office. }{\insrsid15205645\charrsid3307147 This is so because the then Local Governments Act No.1 of 1997 did not contain any provision to the effect that the District Service Commission would seek for further action from the District Council before taking appropriate action on the Tribuna \rquote s Report. T}{\insrsid6647952\charrsid3307147 his Court }{\insrsid8396156\charrsid3307147 thus holds }{\insrsid6647952\charrsid3307147 that on the issuance of the Report by the Tribunal, the power to take \'93appropriate action}{ \insrsid8396156\charrsid3307147 \'94 lay}{\insrsid6647952\charrsid3307147 with the District Service Commission}{\insrsid8396156\charrsid3307147 , without any further directions from the District Council}{\insrsid6647952\charrsid3307147 .}{ \insrsid8396156\charrsid3307147 }{\insrsid6647952\charrsid3307147 This must have }{\insrsid8396156\charrsid3307147 been the intent, purpose}{\insrsid6647952\charrsid3307147 and meaning of section 69(2) of the then }{\insrsid8396156\charrsid3307147 The }{\insrsid6647952\charrsid3307147 Local Governments Act No.1 of 1997 which stated:- \par }{\insrsid1255510\charrsid3307147 \par }{\insrsid6647952\charrsid3307147 \tab }{\b\insrsid6647952\charrsid3307147 \'9369}{\b\insrsid1255510\charrsid3307147 \par }{\b\insrsid6647952\charrsid3307147 \tab (2) The provisions of section 15 except subsection (18) \tab \tab shall apply to the removal of the Chief Administrative \tab \tab Officer or Town Clerk with such modification as may be \tab \tab necessary, but the Tribunal, in this case, shall submit \tab \tab its findings to the District Service Commission to take \tab \tab appropriate action.\'94}{\b\insrsid1796228\charrsid3307147 \par }{\b\insrsid6647952\charrsid3307147 \par }{\insrsid6647952\charrsid3307147 The}{\insrsid8396156\charrsid3307147 real issue for resolution by this court}{\insrsid6647952\charrsid3307147 is whether it was lawful for the District Service Commission to retire the plaintiff in the public interest when she had been exonerated by the Tribunal. \par From the language of section 15(}{\insrsid6751859\charrsid3307147 4}{\insrsid6647952\charrsid3307147 )}{\insrsid6751859\charrsid3307147 and (6)}{\insrsid6647952\charrsid3307147 of }{\insrsid6751859\charrsid3307147 T}{\insrsid6647952\charrsid3307147 he Local Governments Act 1 of 1997, the Tribunal has to report whether it has found the }{\b\insrsid6647952\charrsid3307147 prima facie case}{\insrsid6647952\charrsid3307147 established or not. It is only after the Tribunal has determined that a}{ \b\insrsid6647952\charrsid3307147 prima facie case}{\insrsid6647952\charrsid3307147 for removal has been established that, in case of the District Chairperson, then the Council convenes for purpose of considering passing}{ \insrsid5391583\charrsid3307147 ,}{\insrsid6647952\charrsid3307147 or not passing}{\insrsid5391583\charrsid3307147 ,}{\insrsid6647952\charrsid3307147 a resolution supported by the votes of not less than two thirds of all members of the Council, and once that resolution is passed, then the Chairperson ceases to hold office. \par \par It follows from the wording of section 15 (4) and (6) of the Act, that where the Tribunal finds no }{\b\insrsid6647952\charrsid3307147 prima facie case}{\insrsid6647952\charrsid3307147 established, against the Chairperson, no further action is taken as regards the findings of the Tribunal. In effect, a finding of the tribunal that }{\b\insrsid6647952\charrsid3307147 no prima facie case}{\insrsid6647952\charrsid3307147 is establish ed binds }{\insrsid6751859\charrsid3307147 and stops further action}{\insrsid6647952\charrsid3307147 }{\insrsid3088933\charrsid3307147 intended to remove the Chairperson from office}{\insrsid6751859\charrsid3307147 on the part of the District Council, or any other organ for that matter}{\insrsid3088933\charrsid3307147 .}{\insrsid6647952\charrsid3307147 \par }{\insrsid3088933\charrsid3307147 \par In the same measure}{\insrsid6751859\charrsid3307147 ,}{\insrsid3088933\charrsid3307147 as regards the Chief Administrative Officer, the finding of the Tribunal that no }{\b\insrsid3088933\charrsid3307147 prima facie case}{ \insrsid3088933\charrsid3307147 had been established against the plaintiff bound the District Service Commission}{\insrsid6751859\charrsid3307147 , and the District Council, for that matter,}{\insrsid3088933\charrsid3307147 against taking any action intended to remove the plaintiff from office. The }{\b\insrsid3088933\charrsid3307147 \'93appropriate action\'94}{\insrsid3088933\charrsid3307147 that had to}{\insrsid6751859\charrsid3307147 be}{ \insrsid3088933\charrsid3307147 take}{\insrsid6751859\charrsid3307147 n}{\insrsid3088933\charrsid3307147 , had to be towards and/or related to reinstating the Chief Administrative Officer in office}{\insrsid6751859\charrsid3307147 given the fact that }{ \b\insrsid6751859\charrsid3307147 no prima facie case}{\insrsid6751859\charrsid3307147 had been established against her in respect of all the allegations}{\insrsid3088933\charrsid3307147 . That the above is the correct position}{ \insrsid6751859\charrsid3307147 ,}{\insrsid3088933\charrsid3307147 both in law and }{\insrsid6751859\charrsid3307147 in }{\insrsid3088933\charrsid3307147 fact}{\insrsid6751859\charrsid3307147 ,}{\insrsid3088933\charrsid3307147 is reinforced by the fact that the Tribunal envisaged in section 15(4) of the Local G}{\insrsid6751859\charrsid3307147 overnments\rquote Act No.1 of 1997, was}{\insrsid3088933\charrsid3307147 required to investigate the allegations against the CAO and report the findings stating whether or not there is }{\b\insrsid3088933\charrsid3307147 a prima facie case}{\insrsid3088933\charrsid3307147 for removal of the CAO. Thus the mandate of the Tribunal was by law Judicial, rather than administrative, in that it had to receive facts and then apply the law to them impartially before reaching reason}{\insrsid6751859\charrsid3307147 ed}{ \insrsid3088933\charrsid3307147 decisions on them. The tribunal thus acted as a court of law. As such, the Local Governments Act No.1 of 1997 cannot be said to have vested in the District Service Commission }{\insrsid6751859\charrsid3307147 or for that matter the District Council, with }{\insrsid3088933\charrsid3307147 powers to deal with the Tribunal\rquote s Report in such a way as to find the plaintiff guilty and punish her by removal from office}{\insrsid6751859\charrsid3307147 when t} {\insrsid3088933\charrsid3307147 he Tribunal had exonerated her. Yet the District Service Commission letter }{\insrsid6751859\charrsid3307147 to plaintiff, }{\insrsid3088933\charrsid3307147 Exhibit P1 dated 12}{\super\insrsid3088933\charrsid3307147 th}{ \insrsid3088933\charrsid3307147 August 1999,}{\insrsid6751859\charrsid3307147 with}{\insrsid3088933\charrsid3307147 sub-title: }{\b\insrsid6751859\charrsid3307147 \'93Retirement in Public Interest}{\b\insrsid3088933\charrsid3307147 \'94}{ \b\insrsid6751859\charrsid3307147 }{\insrsid5391583\charrsid3307147 d}{\insrsid6751859\charrsid3307147 id exactly this.}{\insrsid6647952\charrsid3307147 \par }{\b\insrsid6751859\charrsid3307147 \par }{\insrsid3088933\charrsid3307147 An examination of the contents of the }{\insrsid6751859\charrsid3307147 said }{\insrsid3088933\charrsid3307147 letter exhibit P1}{\insrsid6751859\charrsid3307147 ,}{\insrsid3088933\charrsid3307147 clearly shows that the plaintiff }{\insrsid5391583\charrsid3307147 was}{\insrsid3088933\charrsid3307147 punished for the very matters that the Tribunal had exonerated her of. As regards paragraph 3.1 of this letter, the Tribunal dealt with the issue of Bank Acco unt No.3862 in paragraphs 21 to 35 of the report and concluded that there was no illegality at all pertaining to or perpetuated by the plaintiff in respect of the Account. \par }{\insrsid12942448\charrsid3307147 \par The mat}{\insrsid5391583\charrsid3307147 t}{\insrsid12942448\charrsid3307147 ers of the two payments of shs.1,055,000/= and shs.1,000,100/= to Ms Capital Saw Mills and District Internal Security Officer alluded to in paragraph 3.2 of exhibit P1}{ \insrsid6751859\charrsid3307147 ,}{\insrsid12942448\charrsid3307147 were considered by the Tribunal in paragraphs 36 to 42 of the Report and plaintiff was exonerated. }{\insrsid6751859\charrsid3307147 \par \par }{\insrsid12942448\charrsid3307147 Paragraph 4 of exhibit P1 concerned misuse of the two motor-vehicles; Tata Lorry Reg. No. UPB733, and Isuzu-Pick-Up, Double Cabin Reg. No.559UZU. The Tribunal dealt with th}{\insrsid6751859\charrsid3307147 is subject}{ \insrsid12942448\charrsid3307147 in paragraphs 63 to 69 }{\insrsid6751859\charrsid3307147 of the report }{\insrsid12942448\charrsid3307147 and found no merit whatsoever in the allegations. }{\insrsid6751859\charrsid3307147 \par \par W}{\insrsid12942448\charrsid3307147 ith regard to paragraphs 5 and 6 of Exhibit P1, the Tribunal dea}{\insrsid4080096\charrsid3307147 l}{\insrsid12942448\charrsid3307147 t with the allegation of misappropriation of finances by the plaintiff in paragraphs 68 to 73 of the Report and dismissed the same as not proved at all. }{\insrsid4080096\charrsid3307147 \par \par }{\insrsid12942448\charrsid3307147 As to what is stated in paragraph 7 of exhibit P1, the Tribunal dealt with }{\insrsid4080096\charrsid3307147 the same }{\insrsid12942448\charrsid3307147 in paragraphs 44 to 58 and found the}{ \insrsid4080096\charrsid3307147 sa}{\insrsid12942448\charrsid3307147 m}{\insrsid4080096\charrsid3307147 e}{\insrsid12942448\charrsid3307147 not proved. \par \par In the considered view of this court the District Service Commission had no basis and thus wrongly stated and concluded as concerning the plaintiff in exhibit P1 page 4, last paragraph that:- \par }{\b\insrsid12942448\charrsid3307147 \par \tab \'93Arising out of paragraphs 3-7 above based on Tribunal \tab Report, the DSC has concluded that, you, as appointed \tab Head of Public Service in the District, are guilty of \tab incompetence, abuse of office, and financial misconduct.\'94,}{ \insrsid12942448\charrsid3307147 given the fact that the Tribunal Report completely exonerated the plaintiff of any wrong doing of the very same matters. \par \par The District Service Commission was unde}{\insrsid4080096\charrsid3307147 r a duty to act}{\insrsid489563\charrsid3307147 }{\insrsid4080096\charrsid3307147 fairly }{\insrsid489563\charrsid3307147 to}{\insrsid4080096\charrsid3307147 the plaintiff. }{ \insrsid489563\charrsid3307147 }{\insrsid4080096\charrsid3307147 The plaintiff was entitled to be heard in a cause where she was being condemne d and punished by the District Service Commission, and yet the Tribunal of three High Court Judges had exonerated her in the very same cause. The plaintiff was entitled to be treated in accordance with the Rules natural Justice.}{ \insrsid12942448\charrsid3307147 \par }{\insrsid4080096\charrsid3307147 Natural Justice is:- \par }{\b\insrsid489563\charrsid3307147 \tab \'93------- after all ---------- only fair play in action\'94 : }{\insrsid489563\charrsid3307147 See}{\b\insrsid489563\charrsid3307147 : \tab Harman LJ in Ridge Vs. Baldwin [1963] 1 Q B539 at 578. Acting fairly}{ \insrsid489563\charrsid3307147 includes a duty of acting with substantial fairness, consistency, }{\insrsid4080096\charrsid3307147 honestly and without }{\insrsid489563\charrsid3307147 bias and or caprice:}{\b\insrsid489563\charrsid3307147 }{ \insrsid489563\charrsid3307147 See:}{\b\insrsid489563\charrsid3307147 H. T. V. Ltd Vs Price Commission [1976] I. C. R. 170 at 189 (Scarman L. J.) }{\insrsid489563\charrsid3307147 and also see:}{\b\insrsid489563\charrsid3307147 MCInnes Vs. On slow-Fane [1978] 1 WLR 1520. \par }{\insrsid489563\charrsid3307147 \par In the Judgment of this Court, by acting a}{\insrsid3217582\charrsid3307147 s}{\insrsid489563\charrsid3307147 it did}{\insrsid3217582\charrsid3307147 , namely by holding without affording any hearing to plaintiff,}{\insrsid489563\charrsid3307147 that the plaintiff was guilty of incompetence, abuse of office and financial misconduct}{\insrsid3217582\charrsid3307147 ,}{\insrsid489563\charrsid3307147 on the very allegations base}{\insrsid3217582\charrsid3307147 d}{\insrsid489563\charrsid3307147 on the very facts that the tribunal of three Judges of the High Court had exonerated her}{\insrsid3217582\charrsid3307147 of}{\insrsid489563\charrsid3307147 , the District Service Commission acted unfairly and denied natural justice to the plaintiff.}{ \insrsid3217582\charrsid3307147 A decision reached in contravention of the Rules of Natural Justice of Audi Alteram Partem is void ab initio: See: }{\b\insrsid3217582\charrsid3307147 Matovu & 2 Others Vs Sseviri & Another [1979] HCB 174}{ \insrsid3217582\charrsid3307147 . See also: }{\b\insrsid3217582\charrsid3307147 SCCA 3/96: Kamurasi Charles Vs. Accord Properties Limited.}{\insrsid489563\charrsid3307147 \par \par For the reasons stated above, this Court finds on the first issue that the retirement of the plaintiff from the defendant\rquote s employment was unlawful. \par \par The second issue is whether the plaintiff is entitled to the payments under Section 61 (2) (a) (c) and (d) of the Local Governments Act}{\insrsid3217582\charrsid3307147 Cap.243, (Section 62(2) (a) (c) and (d) of Act No.1 of 1997}{ \insrsid5391583\charrsid3307147 )}{\insrsid3217582\charrsid3307147 .}{\insrsid489563\charrsid3307147 }{\insrsid3217582\charrsid3307147 T}{\insrsid489563\charrsid3307147 he section is to the effect that an employee whose services are terminated by the Council contrary to the terms and conditions of service or contrary to the ruling o}{\insrsid8147609\charrsid3307147 f}{\insrsid489563\charrsid3307147 the Public Service Commission shall be entitled to the benefits specified in (a) to (f) of the section. }{\insrsid8147609\charrsid3307147 \par \par }{\insrsid489563\charrsid3307147 To the extent that the plaintiff\rquote s removal from office by retiring her in the public interest as contained in the Defendant\rquote s Dist rict Service Commission decision contained in Exhibit P1 has been held to have been unlawful, it follows therefore that that decision was }{\insrsid4398558\charrsid3307147 contrary to Article 173 of the Constitution and }{\insrsid8147609\charrsid3307147 the then s}{\insrsid4398558\charrsid3307147 ection 60 of the Local Governments Act 1 of 1997. }{\insrsid8147609\charrsid3307147 It is now section 59 of the Local Governments Act, Cap 243.}{\insrsid489563\charrsid3307147 }{ \insrsid4398558\charrsid3307147 Such contravention of the Constitution and the Act entitles the plaintiff }{\insrsid8147609\charrsid3307147 to the benefits which the Act sets out }{\insrsid4398558\charrsid3307147 in Section 62(2) of Act 1 of 1997; }{ \insrsid8147609\charrsid3307147 now section 61(2) of Cap 243, }{\insrsid4398558\charrsid3307147 as such termination was of necessity contrary to the terms and conditions of her service.}{\insrsid489563\charrsid3307147 \par }{\insrsid8147609\charrsid3307147 \par The section}{\insrsid4398558\charrsid3307147 entitles the plaintiff to one year}{\insrsid8147609\charrsid3307147 \rquote }{\insrsid4398558\charrsid3307147 s gross pay in lieu of notice. Plaintiff\rquote s evidence that she was never given any notice}{ \insrsid8147609\charrsid3307147 and that her termination was with }{\b\insrsid8147609\charrsid3307147 \'93immediate effect\'94,}{\insrsid4398558\charrsid3307147 is supported by Exhibit P1 which states on page 5 thereof that:- \par \tab }{\insrsid8147609\charrsid3307147 \'93}{\b\insrsid8147609\charrsid3307147 1. }{\b\insrsid4398558\charrsid3307147 You b}{\b\insrsid8147609\charrsid3307147 e}{\b\insrsid4398558\charrsid3307147 retired from service in public interest without \tab }{ \b\insrsid8147609\charrsid3307147 \tab \tab }{\b\insrsid4398558\charrsid3307147 loss of retirement benefits, }{\b\i\ul\insrsid4398558\charrsid3307147 with immediate effect}{\b\insrsid4398558\charrsid3307147 .\'94}{\b\insrsid8147609\charrsid3307147 \tab \tab \tab Emphasis by court.}{\b\insrsid4398558\charrsid3307147 \par }{\insrsid4398558\charrsid3307147 As to gross pay, plaintiff testified that at}{\insrsid8147609\charrsid3307147 the time of }{\insrsid4398558\charrsid3307147 her termination, her gross pay was shs.789,886/= per month. She tendered to Court the pay slip dated 15.07.99 as Exhibit P6 as proof of this. The plaintiff was not cross-examined on the above evidence.}{\insrsid8147609\charrsid3307147 }{ \insrsid4398558\charrsid3307147 Defence adduced no evidence to re-}{\insrsid5391583\charrsid3307147 b}{\insrsid4398558\charrsid3307147 ut the same. Court thus accepts the plaintiff}{\insrsid8147609\charrsid3307147 \rquote s}{ \insrsid4398558\charrsid3307147 evidence on this point and holds that plaintiff is entitled to one years\rquote gross pay which is Shs.(789,886 x 12) = 9,478,632/=. \par \par }{\insrsid8147609\charrsid3307147 P}{\insrsid4398558\charrsid3307147 laintiff}{\insrsid8147609\charrsid3307147 further claimed }{\insrsid4398558\charrsid3307147 basic salary in lieu of all earned and officially carried forward leave. Plaintiff testified that}{\insrsid8147609\charrsid3307147 ,}{\insrsid4398558\charrsid3307147 as at the time of her removal from office}{\insrsid8147609\charrsid3307147 ,}{\insrsid4398558\charrsid3307147 she was entitled }{ \insrsid8147609\charrsid3307147 to, }{\insrsid4398558\charrsid3307147 as a benefit}{\insrsid8147609\charrsid3307147 ,}{\insrsid4398558\charrsid3307147 by virtue of her public service to earned and officially carried forward leave for five (5) years. To this effect she submitted to }{\insrsid4668600\charrsid3307147 court Exhib its P5 and P6 whereby she earned and was allowed to carry forward 90 days accumulated annual leave for 1984, 1985 and 1986 while }{\insrsid8147609\charrsid3307147 she worked as }{\insrsid4668600\charrsid3307147 assistant District Commissioner, Mbale District, and 60 days accumula}{\insrsid8147609\charrsid3307147 te leave for 1988 and 1989 when she was}{\insrsid4668600\charrsid3307147 Assistant District Executive Secretary 1, Hoima District. \par }{\insrsid4398558\charrsid3307147 \par }{\insrsid4668600\charrsid3307147 The defendant while not rebutting the plaintiff\rquote s evidence submitted that the defendant is not liable to pay the same as the same accrued to the plaintiff while she was in service elsewhere, in Mbale and Hoima Districts respectively. \par \par This Court finds}{\insrsid8147609\charrsid3307147 that the act of the defendant in}{\insrsid4668600\charrsid3307147 unlawfully retiring the plaintiff in the public interest from her public service employment adversely affected the plaintiff\rquote s whole period of service from the time she joined public service up to the time of her removal from office. The defendant thus bears the consequences of the loss and suffering caused to the plaintiff. Court thus }{\insrsid14560655\charrsid3307147 holds the Defendant liable to the plaintiff for the claim of basic salary in lieu of all earned and officially carried forward leave for 5 years which is Shs.(789,886 x 5) = 3,949,430/=. }{\insrsid4668600\charrsid3307147 \par }{\insrsid14560655\charrsid3307147 \par A claim by plaintiff of unpaid salary for the month of August 1999 was not controverted by the defendant. The same is awarded to Plaintiff, that is shs.789,886/=. \par \par }{\insrsid8147609\charrsid3307147 P}{\insrsid14560655\charrsid3307147 laintiff }{\insrsid8147609\charrsid3307147 claims }{\insrsid14560655\charrsid3307147 a severance package equivalent to six (6) months basic pay for every completed year of service}{ \insrsid8147609\charrsid3307147 as provided by the law}{\insrsid14560655\charrsid3307147 . Plaintiff testified that she joined Public Service in June 1980 as Assistant Secretary/Administrative }{\insrsid8147609\charrsid3307147 Officer}{ \insrsid14560655\charrsid3307147 class 2, and rose in ranks up to the level of District Administrative Officer. By the time of her retirement i.e August, 1999, she had served for 19 years. This evidence was not in any way rebutted by the defence. Court accepts the same as truthful. The plaintiff is thus awarded the severance package of Shs.(6 x 789,886 x 19) = 90,047,004/=.}{\insrsid8147609\charrsid3307147 For the same reasons given in respect of the claim of basic salary in lieu of all earned and officially carried forward leave, the defendant is held liable to pay the severance package to the plaintiff.}{\insrsid14560655\charrsid3307147 \par \par The plaintiff\rquote s claim for Transport expenses, Tribunal expenditure and general damages have been consented to by the parties in the sums of Shs.4,676,000/= Transport expense, Shs.8,500,000/= Tribunal expenditure, and Shs.10,000,000/= general damages. \par \par As to the claim for exemplary damag}{\insrsid8147609\charrsid3307147 es, though Court has found }{\insrsid14560655\charrsid3307147 the Defendant\rquote s act of terminating the plaintiff\rquote s employment by retiring her in the public interest to have been illegal and contrary to the Const}{\insrsid12864595\charrsid3307147 itution the evidence}{\insrsid5391583\charrsid3307147 ,}{\insrsid7562301\charrsid3307147 that}{ \insrsid12864595\charrsid3307147 there}{\insrsid8147609\charrsid3307147 }{\insrsid5391583\charrsid3307147 is, }{\insrsid14560655\charrsid3307147 shows that}{\insrsid12864595\charrsid3307147 ,}{\insrsid14560655\charrsid3307147 the plaintiff was not unduly subjected to oppressive and high handed conduct. At }{\insrsid8147609\charrsid3307147 one}{\insrsid14560655\charrsid3307147 time the Chairperson of the District Council apologized to her }{\insrsid8147609\charrsid3307147 as to what had been done to her and for the mistreatment suffered }{\insrsid14560655\charrsid3307147 and in court the Defendant was forthcoming in admitting some of the claims. }{\insrsid8147609\charrsid3307147 }{\insrsid14560655\charrsid3307147 Court, considering the circumstances of this case}{\insrsid8147609\charrsid3307147 ,}{\insrsid14560655\charrsid3307147 on the basis of the evidence availed and conduct of the parties}{\insrsid12864595\charrsid3307147 ,}{\insrsid14560655\charrsid3307147 holds that this is not a case where exemplary damages are awardable.
