The Tribunal found that while the respondent purported to cancel the disposal process after the Contracts Committee had already made a contract award, such cancellation was contrary to section 75(1) of the Public Procurement and Disposal of Public Assets Act and therefore illegal. The Tribunal held that its jurisdiction was not ousted because the cancellation was not effected in accordance with the law. The administrative review decision by the Executive Director was valid as he was presumed to be the Accounting Officer, and the applicant's mis-citation of the relevant statutory section did not affect the Tribunal's jurisdiction.
