Ratio Decidendi

The Court found that the Applicant, being on death row, faces a situation of extreme gravity and a risk of irreparable harm to his rights under Article 7 of the African Charter and Article 14 of the ICCPR if the death sentence were to be carried out. Although the Applicant did not request provisional measures, the Court is empowered to order such measures proprio motu in the interest of justice. The Court determined that the circumstances require an order to preserve the status quo ante, pending the determination of the main application, and that refraining from executing the death penalty is necessary to prevent irreparable harm.
