Ratio Decidendi

The court found that the plaintiff’s suit was barred by the doctrine of res judicata because the issue of the defendant’s caveatable interest in the suit land and the lawfulness of the caveat had already been conclusively determined in HCMA No. 660 of 2007. The plaintiff was aware of this prior ruling, and the cause of action in the present suit was premised on the same facts and issues previously adjudicated. The court held that a plaintiff cannot lawfully plead facts in anticipation of a future cause of action and must rely on existing facts at the time of filing. Since the plaint disclosed no cause of action and was barred by law, the suit was dismissed with costs to the defendant.

Court Disposition

suit dismissed with costs

Orders

  • The plaint is rejected as barred by res judicata.
  • The suit is dismissed with costs to the defendant.
