Procedural Posture

Civil Application / Application for Leave to Appeal Against a Ruling Staying Execution Pending Appeal

  1. 1 Whether the application for leave to appeal against the Principal Judge's order of stay of execution is maintainable after the appeal has been fixed for hearing.
  2. 2 Whether the Principal Judge had jurisdiction to issue the impugned orders.
  3. 3 Whether the grounds set out in the application disclose any proper basis for granting leave to appeal.

Ratio Decidendi

The application for leave to appeal was dismissed as moot because the order of stay of execution, which was the subject of the application, had lapsed upon the appeal being fixed for hearing. The court further held that, even if the application were not moot, it would have been dismissed as misconceived because the Principal Judge had jurisdiction to issue the impugned orders, and there is only one High Court in Uganda with judges empowered to hear any matter. The grounds advanced by the applicants did not disclose any proper basis for granting leave to appeal.
