The court held that when an accused pleads guilty and the circumstances of the offence have not been closely examined, the magistrate must specifically call upon the accused to show cause why his certificate of competency should not be suspended. Failure to do so entitles the appellate court to consider, in the appellant's favour, facts not presented at trial, such as the impact of suspension on livelihood and prior good conduct. In this case, the appellant was not given such an opportunity, and evidence showed he had a clean driving record and depended on his licence for employment.
