Ratio Decidendi

The court held that the claimant, as administrator of the estate of the late Francis Xavier Hatega, was not entitled to accumulated pension or survivor's benefits because the deceased died before retirement and before the commencement of the Pensions (Amendment) Statute No. 4/1994, which introduced survivor's benefits. Pension is only payable to a retired public servant, and ceases upon death unless the death occurs after retirement, in which case survivor's benefits may apply for up to fifteen years. The death gratuity must be calculated based on the salary structure at the time of death, not on current salaries. The court found no legal basis for the claimant's computation of gratuity...
