Procedural Posture

Miscellaneous Application / Ruling

  1. 1 Whether the application raises sufficient grounds for an order of interim stay of execution.
  2. 2 Whether a competent notice of appeal has been filed as a precondition for interim stay of execution.

Ratio Decidendi

The court found that the notice of appeal attached to the application was not signed by the Registrar and therefore was not a competent notice of appeal as required by the Judicature (Court of Appeal Rules) Directions. Since a competent notice of appeal is a mandatory precondition for an application for interim stay of execution, the absence of such notice rendered the application incompetent. The court declined to consider the other grounds advanced for the grant of interim stay, struck out the application, and awarded costs to the respondent.
