Procedural Posture

Miscellaneous Application / Ruling on Taxation Appeal

  1. 1 Whether the registrar erred in the taxation of costs awarded to the respondent.
  2. 2 Whether instruction fees, drawing of documents, attendances, and disbursements were properly taxed in accordance with the Advocates (Remuneration and Taxation of Costs) Regulations 2018.
  3. 3 Whether the agreed items between counsel were in conformity with the law.

Ratio Decidendi

The registrar's taxation was set aside because several items were not taxed in accordance with the Advocates (Remuneration and Taxation of Costs) Regulations 2018. Instruction fees should have been calculated at 10% of the claim exceeding 10,000,000/=. Drawing of documents must comply with Rule 10(3), and attendance fees must be reasonably estimated. Disbursements are legitimate and allowable as part of the bill of costs. The court recalculated the bill of costs, allowing only amounts strictly in line with the regulations and the evidence presented, resulting in a total allowed bill of costs of 9,403,400/=.

Court Disposition

taxation ruling of the registrar set aside; bill of costs retaxed

Orders
