Miscellaneous Application / Ruling on Application to Set Aside Registrar's Order

  1. 1 Whether the decree issued by the labour officer was in strict compliance with the decision and therefore executable.
  2. 2 Whether the applicant owed any balance to the respondent after reconciliation of salary payments and lawful deductions.
  3. 3 Whether deductions for absenteeism were supported by evidence.

Ratio Decidendi

The court found that the decree for payment of 6,000,000/= was not in strict compliance with the labour officer's decision, which required payment of salary arrears less lawful deductions. The decree allowed payment without considering deductions, making it invalid and non-executable. Upon reviewing the evidence, the court agreed that after reconciliation, there was little or no balance payable, except for specific months where deductions for absenteeism were not supported by evidence. The court ordered payment of specified amounts for June, July, and August, and set aside the registrar's notice and decree as null and void.
