The court, therefore, relied on its inherent jurisdiction under the Constitution and the Judicature Act to act as parens patriae. The welfare principle requires that the child's interests be paramount in any decision regarding their property. The applicant, as the natural mother and registered proprietor, is the appropriate person to be appointed guardian of the minor's estate.
