The court held that it is not mandatory for the Bankruptcy Court to impose conditions as to payment when entering judgment pursuant to a conditional order of discharge. Section 3 of the Limitation Ordinance, 1934, applies to such judgments, and the limitation period for execution does not begin until the Bankruptcy Court grants leave under Rule 193 of the Bankruptcy Rules, 1927. Although the judgment was entered in the Bankruptcy Court, execution can only proceed after registration in the Supreme Court Civil Jurisdiction, as the Bankruptcy Court lacks the machinery for execution.
