Ratio Decidendi

The court held that although the Solicitors Act, 1860 does not apply in Kenya as an Act of general application, the common law doctrine of advocate's lien is recognized and applicable. An advocate who has, by his labour, obtained a judgment for his client is entitled to a lien over the proceeds of that judgment. The Kenya Colony Order-in-Council, 1921, is sufficiently broad to allow the application of this common law principle. Therefore, Mr. Birdsey, having recovered the sum for his client through his professional services, is entitled to a common law lien over the funds in court, and his claim prevails over those of other judgment creditors seeking rateable distribution.
