However, the mandatory requirement under the Insolvency Act and Bankruptcy Act is the submission of a statement of affairs to the Official Receiver prior to the issuance of a receiving order. The Petitioner failed to comply with this procedural prerequisite. Therefore, despite evidence of insolvency, the court is precluded from granting the bankruptcy and receiving orders sought until the statement of affairs is properly filed with the Official Receiver.
