Ratio Decidendi

The applicant failed to provide a plausible and satisfactory explanation for his nonappearance at the hearing, as the distance between the registry and the courtroom was minimal and there was no evidence of diligence or honest intent to attend. However, considering the unique and long-standing nature of the matter, the court exercised its discretion to allow reinstatement of the suit as an exception, but only on the strict condition that the applicant pays the taxed costs of the application to the respondents within three months. Failure to comply with this condition would result in the application being dismissed and the suit not reinstated.

Court Disposition

Application allowed conditionally; suit to be reinstated only upon payment of taxed costs within three months.

Orders

  • Civil Suit No. 441 of 2012 shall be reinstated only if the applicant pays the taxed costs of this application to the respondents within three months from 12/07/2021.
  • If the costs are not paid within the stipulated period, the application stands dismissed and the suit shall not be reinstated.
