Ratio Decidendi

The court found that the applicant is the biological father and joint tenant with the minors on the property in question. The applicant's inability to raise school fees for the minors necessitated the application to mortgage the property. The court applied the principle that the welfare of the children is paramount, as provided under Section 3 of the Children Act. Since the mortgage would enable the applicant to raise funds for the educational and other needs of the minors, the court determined that granting the guardianship order was in the best interests of the children. The court therefore appointed the applicant as guardian to enable him to mortgage the property for the stated purpose.
