Ratio Decidendi

The plaintiff proved on a balance of probabilities that it is an unpaid seller, the goods remain in transit under the custody of Uganda Revenue Authority, and the defendants, having impersonated another company and failed to pay, are unlikely to perform their contractual obligations. The right of stoppage in transitu is triggered by the apparent inability or unwillingness of the buyer to pay, even absent an actual breach. The plaintiff is entitled to take possession of the goods and have them re-exported at its cost, with the defendants jointly and severally liable for reimbursement of storage and redelivery costs, as well as costs of the suit.
