Miscellaneous Application / Ruling

  1. 1 Whether the judgment in Civil Appeal No. 0066 of 2022 should be corrected under the Slip Rule to specifically provide for payment of costs of the suit in the lower court to the applicants.
  2. 2 Whether the omission of the order for costs in the lower court constitutes an error apparent on the face of the record.

Ratio Decidendi

The omission of an explicit order upholding the judgment and orders of the lower court, including costs, in the appellate judgment was an accidental slip that did not reflect the manifest intention of the court. The appellate court's dismissal of the appeal for incompetence meant that the lower court's judgment and orders, including costs, remained unaltered. Section 99 of the Civil Procedure Act empowers the court to correct such errors at any time, ensuring that the record accurately reflects the court's intention. The application to correct the judgment is therefore merited, and the final orders are amended to explicitly uphold the judgment and orders of the lower court.
