The defendant's occupation was not based on any contractual relationship, so the plaintiff was not entitled to rent but to mesne profits for wrongful deprivation of use. The plaintiff failed to prove special damages, which were therefore disallowed. Based on the evidence of agricultural use of the remaining land, the court awarded mesne profits at a reasonable rate per acre per annum for the period of trespass, general damages for inconvenience and pain, and ordered vacant possession.
