The purpose of the adjournment was for both parties to report to court as to how the terms of the consent order had been carried out by the parties. \par \par Both parties reported back to court but on different days and with different versions. \par \par Learned counsel }{\insrsid3870906\charrsid16136103 Moses}{\insrsid7354492\charrsid16136103 Ojakol reported to court alone on 29}{\super\insrsid7354492\charrsid16136103 th}{\insrsid7354492\charrsid16136103 November 2005. \par \par His submission to court was that the Consent order had been carried out to the letter and therefore the case should be taken as concluded and the court file marked so. \par \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid16136103 {\insrsid7354492\charrsid16136103 The court, aware that, on 29}{\super\insrsid7354492\charrsid16136103 th}{\insrsid7354492\charrsid16136103 November 2005, access by the public to the High Court premises had been restrictive, stood over the case and awaited a report from the plaintiffs; when the situation at the court premises had returned to normal. \par \par On 30}{\super\insrsid7354492\charrsid16136103 th}{\insrsid7354492\charrsid16136103 November 2005 Senior Counsel Godfrey Lule, for the plaintiffs and Rwanyarare, one of the plaintiffs, reported to court. The plaintiffs totally rejected the report made to court by Learned Counsel Mr. Ojakol. They contended no meeting of the Nati onal Council ever took place. \par \par The court, on receipt of the conflicting }{\insrsid12722536\charrsid16136103 reports from the parties to the consent order, summoned the parties for further action that will conclusively determine the case. \par \par Learned Counsel Mr. Wakida has submitted for the Defendants that the Consent order of 23}{\super\insrsid12722536\charrsid16136103 rd}{\insrsid12722536\charrsid16136103 November 2005 was a judgment and therefore this court cannot re-open the case. The court is fuscous official. \par \par Senior Counsel Mr. Godfrey Lule has, in opposition to Mr. Wakida, submitted that the consent order was interlocutory in nature and that it did not amount to a judgment conclusively deciding the issues in the case. \par \par In the considered view of this court, no judgment has ever been reached in this case. The consent order required certain matters to be carried out in accordance with the terms of that order.
