The Respondent's attempt to seek leave by letter was improper and offended the rules. The preliminary objection regarding non-service was dismissed because the Respondent had been served pursuant to a court order and had participated in the proceedings. However, in the absence of a proper application for extension of time to serve fresh summons, Civil Suit No. 887 of 2019 was found incompetent for want of service of summons and was accordingly dismissed.
