The absence of summing up notes to the assessors and the lack of recorded assessor opinions constituted a procedural irregularity under Section 82(1) of the Trial on Indictments Act. This omission rendered the entire trial a nullity, regardless of the substantive grounds of appeal. The appellate court is bound to set aside the conviction and sentence where such a fundamental procedural error is detected, even if not argued by counsel. The appellant's prolonged period in custody was also considered sufficient to serve any possible sentence, warranting his immediate release unless held on other lawful grounds.
